1. Agreement and eligibility

These Terms govern your access to RTHMN websites, market data, analytical tools, software, documentation, and related services (collectively, the “Services”). By creating an account, purchasing a subscription, accepting the Trade policy, or using the Services, you agree to these Terms.

You must be at least 18, able to form a binding contract, and permitted to use the Services and any connected broker in your jurisdiction. If you do not agree, do not use the Services.

2. What RTHMN provides

RTHMN provides market-structure data, analytical software, and an optional locally operated experimental Trade terminal. RTHMN Trade is beta software, not a financial instrument. It is under active development and may change, contain defects, lose compatibility, or be suspended or discontinued. It is not intended for unattended, emergency, or mission-critical use.

The desktop reads selected market quotes from a supported local source and sends normalized quote data to RTHMN for server-side analysis. RTHMN returns a reduced Trend Hint for display or an optional local handoff. Only after you separately configure and enable broker execution can the desktop submit, modify, or close orders without asking for confirmation before each action. Use a demonstration account first.

RTHMN is not your broker, dealer, exchange, custodian, bank, fiduciary, attorney, tax adviser, or individualized investment adviser. RTHMN does not receive deposits, hold customer trading funds, guarantee execution, or guarantee any trading outcome.

3. Accounts, plans, and payments

You must provide accurate account information, protect your RTHMN credentials, and promptly report suspected unauthorized access. Trade access requires an active Builder subscription and acceptance of the current Trade terms. Desktop access and active scanning stop when eligibility ends, a device is revoked, or the current Trade terms have not been accepted.

Prices, billing intervals, renewal terms, and any offer-specific refund terms are shown at checkout or in the applicable purchase terms. Subscriptions renew until cancelled. Except where a posted offer or applicable law requires otherwise, charges already incurred are not refundable.

4. Local Trade software and credentials

You must use your own broker account and credentials. If you enable TradeLocker API execution, you must also use your own account identifiers and TradeLocker developer API key. RTHMN does not provide, lend, share, recover, or authorize a shared developer key.

RTHMN never receives or retains your private broker credentials or TradeLocker developer API key. The desktop keeps them on your device and, when needed, sends them directly from your device to TradeLocker. They do not pass through RTHMN's servers. Local settings, a revocable RTHMN device credential, and a dedicated browser profile also remain on your device. Do not send any credential to RTHMN support or place it in source code, screenshots, chat, tickets, or other third-party systems. You are responsible for device security and for rotating or revoking exposed credentials.

The RTHMN device credential authorizes this installation to request a short-lived scanning session. It cannot authorize broker trading. Your TradeLocker credentials and developer key remain separate and are used locally to connect directly to TradeLocker.

5. Brokers and other third parties

RTHMN supports only the broker profiles identified as available in the current desktop release. Support is a technical compatibility statement, not an endorsement, recommendation, warranty, partnership, or representation that a broker is licensed or appropriate for you. RTHMN is not affiliated with, endorsed by, or in an official partnership with TradeLocker.

TradeLocker, HeroFX, payment processors, market-data providers, and other third parties are independent services governed by their own terms and privacy practices. You are responsible for confirming that your broker, account, products, leverage, developer access, and intended use are lawful and permitted. Third-party changes, rate limits, suspensions, outages, or account restrictions may interrupt or end compatibility without notice.

6. Trading risks and no advice

Trading foreign exchange and other leveraged products involves a substantial risk of loss and is not suitable for everyone. You may lose some or all capital in your broker account and, depending on the product, broker, and applicable rules, more than the amount deposited. Past, simulated, backtested, or hypothetical results do not predict future performance.

RTHMN does not promise profits or provide individualized financial, legal, or tax advice. You decide whether to trade, whether to enable live execution, which settings and risk limits to use, and when to stop the software. The current  Automated Trading Risk Disclosure   is incorporated into these Terms for every Trade user.

7. Service and execution limitations

The Services are provided “as is” and “as available.” Market conditions, differences between quote sources, stale or incorrect data, local device failures, cloud-service failures, connectivity, software defects, clock differences, broker rules, API changes, rate limits, liquidity, gaps, slippage, and rejected orders can cause delayed, missed, duplicate, unintended, or differently priced actions. Stops and other protective instructions do not guarantee an execution price or prevent loss.

Beta updates may change configuration formats, strategies, supported markets, broker behavior, interfaces, or local data. RTHMN does not guarantee backward compatibility or continued availability during the beta.

You must supervise the terminal, review settings before enabling live orders, maintain independent access to your broker, and be prepared to stop the software or manage positions directly.

8. License and intellectual property

Subject to these Terms and applicable fees, RTHMN grants you a limited, non-exclusive, non-transferable license to use proprietary parts of the Services for personal or internal business use. You may not redistribute, resell, circumvent access controls for, or attempt to extract proprietary private-engine source code.

Open-source components, including any publicly released terminal code, are governed by the licenses included with those components. Nothing in these Terms restricts rights expressly granted by an applicable open-source license.

9. Acceptable use

You must not:

  • share, sell, or expose RTHMN or broker credentials;
  • bypass plan, policy, key, or broker-profile enforcement;
  • use the Services for manipulation or unlawful trading;
  • interfere with service integrity or another user; or
  • misrepresent RTHMN output or performance.

10. Disclaimers and limitation of liability

To the maximum extent permitted by applicable law, RTHMN disclaims implied warranties, including merchantability, fitness for a particular purpose, non-infringement, uninterrupted availability, and accuracy. Nothing excludes a warranty or remedy that cannot lawfully be excluded.

To the maximum extent permitted by applicable law, RTHMN is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages; trading losses; lost profits; lost data; or third-party acts. RTHMN’s aggregate liability arising from the Services will not exceed the amount you paid RTHMN during the 12 months before the event giving rise to the claim. This limitation does not apply where prohibited by law.

11. Suspension, termination, and changes

You may stop using the Services at any time. RTHMN may suspend or terminate access for nonpayment, loss of eligibility, security risk, policy nonacceptance, misuse, legal requirements, or service discontinuation. Provisions concerning ownership, risk, disclaimers, liability, and accrued obligations survive.

RTHMN may revise these Terms to reflect product, security, legal, or operational changes. Material Trade changes receive a new policy version. You must review and accept that version before Desktop access or scanning remains usable.

12. Applicable law and disputes

Applicable law determines the governing law, forum, and any non-waivable consumer rights. These Terms do not require arbitration or waive a class, jury, statutory, or regulatory right unless RTHMN and you later enter a separate enforceable written agreement that expressly does so.
